Do I have to put up the video surveillance sign?
Yes. You have to inform people before anybody enters the recorded area, and that is done with a visible sign placed at the entrances. The General Data Protection Regulation requires it, obliging you to inform people at the moment the data is collected, and article 22 of Organic Law 3/2018 sets out the detail for video surveillance.
The sign cannot just say «video surveillance area». It has to give the basic information: who the data controller is, why the recording is made, that there are rights of access, erasure and the rest, and where the full information can be consulted —a web address, an email, or a document available at reception—. The Spanish Data Protection Agency publishes a model sign that meets this and can be used as it is.
The extended information has to actually be where the sign says it is, and that is the commonest failing: correct signs pointing to a document nobody has written. Every installation has its particulars —who the controller is when there are several companies in the same building, for example— and it is worth going through them case by case.
