Can I record the pavement in front of my business?
Only what is essential. Surveillance of the public highway is a matter for the State security forces, and a private individual or a company may only capture public highway to the extent strictly necessary to protect their own premises, people and property, as article 22 of Organic Law 3/2018 sets out.
In practice that means you can take the strip of pavement against the front of the building, the entrance and whatever is needed to see who is coming up to the door, and not the whole street, the pavement opposite or the neighbour's doorway. When the field of view unavoidably takes in more than it should, the usual route is to mask that part of the image in software, which on most cameras and video systems is set up by painting a fixed black area that is not recorded.
Two things help you hold the line if somebody asks: putting in writing why that field of view is the minimum needed, and keeping the image from each camera exactly as it stood on the day of handover. It is a subject where the particular detail counts for a lot, so in doubtful cases it is worth going over it with whoever handles data protection at the company.
